DPD 2019: Germany's Federal Data Protection Act
The GDD-Guidelines "Germany's Federal Data Protection Act (FDPA)" present the most relevant provisions of Germany's national implementation law for the private sector in view of the GDPR.
On the occasion of the 13th European Data Protection Day 2019, the GDD wants to raise the awareness of those responsible for data protection who do not provide counsel and monitoring in or from a German branch or who do not speak German. In the GDD-Guidelines "Germany's Federal Data Protection Act (FDPA)", the most relevant provisions of Germany's national implementation law in view of the GDPR for the private sector will presented to foreign interested parties.
Hot topics of these guidelines include the lawfulness of data processing, restrictions on data subjects' rights, the data protection officer and the competences of the supervisory authorities.
The guidelines do not only aim at raising awareness among interested parties, but also at contributing to the current status of national implementation legislation. Although not all member states have already passed a law, it would be desirable from the GDD's point of view if there existed more transparency regarding applicable or envisaged implementation laws.

Zum 13. Europäischen Datenschutztag 2019 möchte die GDD diejenigen Verantwortlichen im Datenschutz sensibilisieren, die nicht in einer deutschen Niederlassung für einen Schutz personenbezogener durch Beratung und Kontrolle sorgen oder die nicht der deutschen Sprache mächtig sind. In der GDD-Praxishilfe "Germany's Federal Data Protection Act" wird für ausländische Interessierte das BDSG als nationales Implementierungsgesetz in seinen für die Privatwirtschaft wichtigsten Regelung vorgestellt.
Themen
Themen der Praxishilfe sind u.a. die Zulässigkeit der Datenverarbeitung, Restriktionen bei den Betroffenenrechten, der Datenschutzbeauftragte sowie Kompetenzen der Aufsichtsbehörden.
Die Praxishilfe möchte nicht nur Interessierte sensibilisieren, sondern auch einen Beitrag zum aktuellen Stand der nationalen Implementierungsgesetze leisten. Zwar verfügen nicht alle Mutgliedstaaten bereits über ein verabschiedetes Gesetz, es wäre jedoch aus Sicht der GDD wünschenswert, wenn mehr Transparenz hinsichtlich der Implementierungsgesetze bestünde.
