The AI Act establishes the framework for the use of AI in Europe. According to Article 4 of the AI Act, companies operating AI systems must ensure that their employees and third parties have a sufficient level of AI literacy. This obligation includes, in particular, data protection skills. Any company that uses AI in any form is considered a deployer.
In view of the complex provisions of the AI Act, which supplement and interact with the GDPR, AI controllers are required to provide qualified training for all employees involved in the planning and use of AI that is relevant to the conditions of employment, in addition to the general obligation to im-part AI literacy. This is the only way to en-sure that AI is used in compliance with the GDPR and AI Regulation and to avoid fines under the GDPR and AI Act and claims for damages due to breaches of obligations un-der the GDPR and AI Act.
